Chipmunk Bounce Houses Rental Agreement, Safety Rules, Assumption of Risk, Release of Liability & Indemnification Terms

Effective Date: August 27, 2026

This Rental Agreement, Safety Rules, Assumption of Risk, Release of Liability, and Indemnification Agreement (“Agreement”) applies to all rentals provided by Peak Event Group, LLC, doing business as Chipmunk Bounce Houses (“Chipmunk Bounce Houses,” “Company,” “we,” “us,” or “our”).

By making a reservation, submitting payment, signing electronically, checking an acceptance checkbox on our website, or accepting delivery of rental equipment, the customer (“Customer,” “Renter,” “you,” or “your”) acknowledges that they have read, understood, and agreed to the terms below.

1. Rental Equipment Covered

This Agreement applies to all equipment rented or provided by Chipmunk Bounce Houses, including but not limited to:

  • Bounce houses

  • Water slides

  • Dry slides

  • Combo inflatables

  • Obstacle courses

  • Interactive inflatables

  • Inflatable games

  • Tables

  • Chairs

  • Concession equipment

  • Blowers

  • Tarps

  • Electrical cords

  • Generators

  • Accessories

  • Other party and event rental equipment

 

2. Customer Responsibility

The Customer assumes responsibility for the rental equipment from the time it is delivered or placed at the event location until the equipment is collected by Chipmunk Bounce Houses.

The Customer agrees to:

  • Provide a safe and accessible setup location.

  • Provide accurate information regarding the event location and setup surface.

  • Ensure adequate space is available for the equipment.

  • Follow all safety instructions provided by Chipmunk Bounce Houses.

  • Ensure all participants and guests follow applicable safety rules.

  • Protect the equipment from theft, vandalism, pets, fire, sharp objects, misuse, and unauthorized handling.

  • Immediately stop use of any equipment if an unsafe condition develops.

  • Prevent unauthorized persons from moving or modifying equipment.

 

The Customer is responsible for communicating all applicable safety rules to guests, parents, guardians, participants, and event staff.

 

3. Adult Supervision Required

A responsible adult age 18 or older must actively supervise inflatable equipment at all times while it is in use.

The supervising adult is responsible for:

  • Monitoring participants continuously.

  • Preventing overcrowding.

  • Stopping rough or unsafe behavior.

  • Separating participants of significantly different sizes when appropriate.

  • Ensuring entrances and exits remain clear.

  • Enforcing all posted and provided safety rules.

  • Immediately stopping use during unsafe weather conditions.

 

Chipmunk Bounce Houses does not provide continuous supervision unless staffing services are separately purchased and confirmed in writing.

 

4. General Inflatable Safety Rules

 

Participants must not:

  • Perform flips, somersaults, wrestling, or rough play.

  • Push, tackle, strike, or intentionally collide with other participants.

  • Climb, sit, hang, or stand on inflatable walls, barriers, netting, or roofs.

  • Bring food, drinks, gum, candy, or beverages inside inflatable equipment.

  • Bring sharp objects, toys, keys, pens, tools, jewelry, or other hazardous objects inside.

  • Wear shoes inside inflatable equipment unless specifically authorized.

  • Bring pets or animals onto inflatable equipment.

  • Use Silly String, confetti, glitter, markers, paint, face paint, or similar substances.

  • Smoke, vape, use fireworks, candles, grills, or open flames near rental equipment.

  • Move or tamper with blowers, cords, stakes, straps, anchors, sandbags, or other safety equipment.

 

Participants must:

  • Follow all capacity and weight restrictions.

  • Enter and exit only through designated openings.

  • Follow instructions from the supervising adult.

  • Exit immediately if the inflatable loses air or if instructed to do so.

5. Water Slide and Wet Inflatable Rules

 

For water slides and wet-use inflatables:

  • Riders must wait until the previous participant has cleared the landing area.

  • Participants must slide feet first unless the manufacturer's instructions specifically state otherwise.

  • No diving or head-first sliding.

  • No running, jumping, pushing, or horseplay in landing pools.

  • No climbing upward on slide lanes.

  • Children must be closely supervised around water.

  • Participants must promptly exit the landing or pool area after sliding.

  • Water levels must be monitored by an adult.

 

The Customer acknowledges that water activities involve additional risks, including slipping, falling, collision, drowning, and serious injury.

 

6. Weather and Wind Safety

Inflatables must not be used during unsafe weather.

The Customer must immediately stop use and evacuate inflatable equipment in the event of:

  • Lightning

  • Thunderstorms

  • Heavy rain

  • Dangerous winds or wind gusts

  • Tornado warnings

  • Severe weather alerts

  • Flooding

  • Electrical interruption

  • Any other condition that makes continued operation unsafe

 

Inflatables must not be operated when wind conditions exceed the manufacturer's safe operating limits.

Chipmunk Bounce Houses may refuse setup, delay setup, discontinue operation, remove equipment, or cancel installation when weather or site conditions create a safety concern.

Safety decisions made by Chipmunk Bounce Houses regarding equipment operation or installation are final.

 

7. Electrical Safety

Inflatable blowers require continuous electrical power.

Customers agree that:

  • Blowers must remain operating while inflatable equipment is in use.

  • Electrical cords and connections must not be moved or tampered with.

  • Children must remain away from blowers and electrical equipment.

  • Electrical equipment should be protected from standing water whenever applicable.

  • Participants must immediately exit the inflatable if power is lost.

 

Chipmunk Bounce Houses is not responsible for insufficient electrical service, tripped breakers, outages, or electrical problems outside the Company's control.

 

8. Setup Area and Underground Utilities

The Customer must accurately inform Chipmunk Bounce Houses of the setup surface, including grass, concrete, asphalt, artificial turf, pavers, indoor flooring, or other surfaces.

The Customer must disclose any known:

  • Irrigation systems

  • Sprinkler lines

  • Septic systems

  • Electrical lines

  • Plumbing

  • Gas lines

  • Invisible fencing

  • Underground structures

  • Other concealed hazards

 

Chipmunk Bounce Houses is not responsible for damage to undisclosed underground systems or objects caused during normal and reasonable installation, except where otherwise required by law.

The Company may refuse installation at an unsafe location.

9. Equipment May Not Be Moved

Once inflatable equipment has been installed by Chipmunk Bounce Houses, the Customer may not move, relocate, reposition, detach, or modify the equipment.

This includes:

  • Inflatable units

  • Blowers

  • Stakes

  • Straps

  • Anchoring systems

  • Sandbags

  • Electrical cords

  • Tarps

 

Unauthorized relocation or modification may result in immediate termination of the rental without refund.

 

10. Tables and Chairs

Unless specifically stated otherwise in the Customer's order, Chipmunk Bounce Houses employees are not responsible for setting up, arranging, repositioning, folding, stacking, or taking down tables or chairs.

The Customer is responsible for:

  • Setup

  • Placement

  • Takedown

  • Folding

  • Stacking

  • Keeping equipment clean

  • Protecting equipment from damage

  • Making equipment accessible for pickup

 

Customers and guests must not stand, climb, jump, or play on tables or chairs.

 

11. Damage, Cleaning, Loss, and Theft

The Customer agrees to return rental equipment in substantially the same condition in which it was received, ordinary wear and tear excepted.

The Customer may be responsible for reasonable repair, replacement, or cleaning costs resulting from:

  • Misuse

  • Negligence

  • Unauthorized movement

  • Theft

  • Vandalism

  • Pets

  • Sharp objects

  • Silly String

  • Confetti

  • Glitter

  • Paint

  • Markers

  • Face paint

  • Food

  • Gum

  • Candy

  • Mud

  • Fire

  • Fireworks

  • Smoking

  • Unauthorized chemicals

  • Failure to supervise participants

 

Intentional damage or theft may be reported to law enforcement.

 

12. Delivery and Pickup Access

The Customer must provide clear and reasonable access to the setup and pickup location.

The Customer must notify Chipmunk Bounce Houses in advance of any:

  • Stairs

  • Elevators

  • Narrow gates

  • Long-distance carries

  • Restricted entrances

  • HOA restrictions

  • Community security requirements

  • Parking restrictions

  • Difficult terrain

  • Rooftop installations

  • Indoor installations

  • Other unusual access conditions

 

Additional fees may apply when actual conditions differ materially from the information provided at booking.

Chipmunk Bounce Houses may refuse delivery or installation when access conditions are unsafe or impractical.

13. Property Authorization

 

The Customer represents that they either:

  • Own the property where the equipment will be installed; or

  • Have permission from the property owner, venue, HOA, community association, municipality, school, business, or controlling authority to install and operate the rental equipment.

 

The Customer is responsible for obtaining permits, HOA approvals, venue approvals, or other permissions unless Chipmunk Bounce Houses agrees otherwise in writing.

14. Assumption of Risk

The Customer understands and acknowledges that inflatable equipment, water activities, party rentals, and recreational activities involve inherent and other risks.

These risks may include:

  • Slipping

  • Falling

  • Tripping

  • Collision

  • Cuts

  • Scrapes

  • Bruises

  • Sprains

  • Broken bones

  • Head injuries

  • Neck injuries

  • Back injuries

  • Water-related injuries

  • Electrical hazards

  • Weather-related hazards

  • Serious bodily injury

  • Permanent disability

  • Drowning

  • Death

 

The Customer knowingly and voluntarily assumes the risks associated with possession, supervision, operation, and use of rental equipment.

The Customer agrees to ensure that participants use the equipment safely and follow all applicable rules.

15. Release of Liability

TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW, the Customer releases and agrees not to bring claims against:

Peak Event Group, LLC d/b/a Chipmunk Bounce Houses, together with its members, owners, managers, employees, agents, contractors, representatives, affiliates, successors, and assigns,

for claims arising from or relating to the possession, supervision, operation, or use of rented equipment, including claims involving bodily injury, property damage, serious injury, or death.

This release includes claims arising from ordinary negligence to the extent such a release is permitted and enforceable under Florida law.

This release does not apply to liability that cannot legally be waived under applicable law.

16. Indemnification

 

To the fullest extent permitted by applicable law, the Customer agrees to defend, indemnify, and hold harmless Peak Event Group, LLC d/b/a Chipmunk Bounce Houses, together with its members, owners, managers, employees, agents, contractors, representatives, affiliates, successors, and assigns, from third-party claims, damages, liabilities, losses, expenses, and reasonable attorneys' fees arising from or related to:

  • Failure to follow this Agreement.

  • Failure to supervise participants.

  • Misuse of equipment.

  • Unauthorized movement or modification of equipment.

  • Unsafe conduct by guests, invitees, or participants.

  • Unsafe conditions created or controlled by the Customer.

  • Failure to disclose relevant property conditions.

  • Violations of safety instructions.

 

17. Participants and Minors

The Customer is responsible for supervising minors and obtaining any parental or guardian permissions required for participants attending the event.

The Customer must not allow any person to participate if the Customer or supervising adult reasonably believes that participation would be unsafe.

18. Medical Conditions

Individuals with medical conditions that could make recreational activity unsafe should not participate without appropriate medical guidance.

This may include individuals who are:

  • Pregnant

  • Recovering from recent surgery

  • Experiencing back or neck problems

  • Experiencing heart conditions

  • Experiencing serious bone or joint conditions

  • Experiencing seizure disorders

  • Experiencing significant balance problems

 

Chipmunk Bounce Houses does not provide medical advice or determine whether an individual is medically fit to participate.

19. Alcohol and Impairment

Anyone who is intoxicated or impaired by alcohol, illegal drugs, controlled substances, or any substance affecting judgment, balance, coordination, or awareness may not use inflatable equipment.

The supervising adult is responsible for enforcing this restriction.

20. Right to Refuse or Discontinue Service

Chipmunk Bounce Houses may refuse installation, stop operation, or remove equipment whenever Company personnel reasonably determine that conditions are unsafe.

Unsafe conditions may include:

  • Dangerous weather

  • Excessive wind

  • Unsafe surfaces

  • Electrical hazards

  • Insufficient anchoring capability

  • Inadequate space

  • Unsafe access

  • Customer interference with installation

  • Dangerous participant behavior

  • Unauthorized equipment relocation

  • Failure to follow Company instructions

 

Safety takes priority over completion of the rental.

21. Equipment Problems or Failure

If rental equipment develops a mechanical or operational problem, the Customer must immediately discontinue use and contact Chipmunk Bounce Houses.

Customers may not attempt unauthorized repairs.

Chipmunk Bounce Houses will determine the appropriate remedy based on the circumstances and equipment availability.

To the fullest extent permitted by law, Chipmunk Bounce Houses is not responsible for consequential or indirect losses, including lost event revenue, venue costs, catering costs, entertainment costs, or other third-party expenses caused by an equipment interruption or failure.

22. Cancellation, Weather, Payment, and Refund Policies

 

All reservations are also subject to Chipmunk Bounce Houses' current:

  • Cancellation policy

  • Weather policy

  • Payment policy

  • Rescheduling policy

  • Refund policy

 

Any policies presented during booking or published on our website are incorporated into this Agreement.

23. Customer Inspection

The Customer agrees to inspect the rental equipment upon delivery or before use and promptly notify Chipmunk Bounce Houses of any visible problem or unsafe condition.

The Customer must immediately discontinue use if an unsafe condition develops during the rental.

24. No Subleasing or Transfer

Rental equipment may not be:

  • Subleased

  • Transferred to another customer

  • Moved to another event

  • Moved to another address

  • Placed under the control of an unauthorized third party

 

without written authorization from Chipmunk Bounce Houses.

25. Governing Law and Venue

This Agreement is governed by the laws of the State of Florida.

To the extent permitted by applicable law, disputes arising from this Agreement shall be brought in a court of competent jurisdiction located in Collier County, Florida.

 

26. Severability

If any part of this Agreement is determined to be invalid or unenforceable, that provision shall be enforced to the maximum extent legally permitted, and the remaining provisions shall remain in effect.

 

27. Entire Agreement

This Agreement, together with the Customer's reservation, invoice, applicable booking policies, safety instructions, and written addenda, constitutes the agreement between the parties regarding the rental.

No oral statement modifies this Agreement unless confirmed in writing by an authorized representative of Peak Event Group, LLC.

28. Electronic Acceptance

Electronic acceptance of this Agreement shall have the same effect as a handwritten signature to the extent permitted by applicable law.

By checking the required acceptance checkbox on a Chipmunk Bounce Houses form, booking page, or checkout page, the Customer confirms:

I HAVE READ, UNDERSTAND, AND AGREE TO THE CHIPMUNK BOUNCE HOUSES RENTAL AGREEMENT, SAFETY RULES, ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND INDEMNIFICATION TERMS. I UNDERSTAND THAT USE OF RENTAL EQUIPMENT MAY INVOLVE RISKS OF PROPERTY DAMAGE, PERSONAL INJURY, SERIOUS INJURY, OR DEATH. I AGREE TO FOLLOW ALL APPLICABLE SAFETY RULES AND ACCEPT THE TERMS OF THIS AGREEMENT.

 

Important Safety Reminder

Adult supervision is required at all times while inflatable equipment is in use.

Do not use inflatable equipment during dangerous wind, lightning, thunderstorms, or other unsafe weather.

Do not move or modify inflatables, blowers, stakes, straps, sandbags, electrical cords, or other safety equipment after installation.

If an unsafe condition develops, immediately stop use and contact Chipmunk Bounce Houses.
